This website is operated by Mark Davis Collections. Throughout the site, the terms "we", "us" and "our" refer to Mark Davis Collections.

By accessing our website or purchasing products from us, you agree to these Terms of Service, together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy.

2. Products and Availability

Mark Davis Collections offers artwork-inspired merchandise, prints and other products featuring the work of artist Mark Davis.

We make every effort to accurately represent our products through photographs, descriptions and specifications. However, colours may vary slightly depending on your screen settings, printing processes and materials.

Product availability may change without notice.

We reserve the right to discontinue products or limit quantities where reasonably necessary.

3. Preorders and Production Times

Many products available through Mark Davis Collections are sold on a preorder basis.

Unless otherwise stated on the product page, preorder merchandise has an estimated dispatch timeframe of 3–4 weeks from the date of purchase.

This timeframe is an estimate and does not include delivery time.

Payment is collected when the order is placed, even if the product has not yet been produced or dispatched.

We aim to fulfil all orders within the estimated timeframe. If a significant delay occurs, we will contact affected customers with an update and available options.

Customers may request cancellation of standard, non-personalised preorder merchandise before dispatch, in accordance with our Returns & Refunds Policy.

Nothing in these terms limits your rights under Australian Consumer Law if an order is significantly delayed or cannot be fulfilled within a reasonable timeframe.

4. Pricing and Payment

All prices displayed on our website are in Australian dollars (AUD).

Any applicable taxes are included or calculated as indicated at checkout, in accordance with Australian law.

Shipping charges are calculated and displayed before an order is completed.

We reserve the right to change product prices at any time. Changes will not affect orders that have already been accepted and paid for.

Orders are subject to successful payment processing and acceptance.

5. Orders

When you place an order, you agree to provide accurate and complete contact, billing and delivery information.

An order confirmation email acknowledges receipt of your order.

If we are unable to fulfil an order, we will contact you to discuss available options, including a refund where appropriate.

We may cancel orders where reasonably necessary, including where a product is unavailable, payment cannot be processed or fraudulent activity is suspected. Any payment received for an order cancelled by us will be refunded.

6. Shipping and Delivery

We currently ship within Australia only.

Our shipping options include:

• Standard shipping: $11 AUD

• Free standard shipping on orders of $100 AUD or more

• Express shipping: $15 AUD

Shipping costs and available delivery options are confirmed at checkout.

Delivery times are additional to preorder production and dispatch timeframes.

Selecting express shipping does not shorten the estimated production period.

7. Returns, Exchanges and Refunds

We offer 14-day change-of-mind returns on eligible products, subject to the conditions outlined in our Returns & Refunds Policy.

Customers are generally responsible for return postage for change-of-mind returns.

Personalised or individually customised products may be excluded from voluntary change-of-mind returns.

Preorder merchandise is eligible for change-of-mind returns unless otherwise specified in accordance with our policy.

All returns, exchanges, refunds and cancellations are subject to our Returns & Refunds Policy and applicable Australian law.

Nothing in these terms excludes or restricts your rights under Australian Consumer Law.

8. Intellectual Property and Artwork

All original artwork, illustrations, designs, photographs, written content, branding and other creative materials displayed on this website are owned by Mark Davis Collections, Mark Davis or their respective rights holders, unless otherwise stated.

Purchasing a product does not transfer copyright or other intellectual property rights in the artwork or designs featured on that product.

You may not reproduce, distribute, modify, commercially exploit or use our artwork, designs or website content without the permission of the relevant rights holder, except where permitted by law.

9. Website Use

You agree to use our website lawfully and responsibly.

You must not:

• Use the website for fraudulent or unlawful purposes.

• Attempt to interfere with the website's security or functionality.
